Please read these Terms of Use ("Terms") carefully before using the Blackjack Social mobile application (the "App") operated by Blackjack Social ("we," "us," or "our"). By downloading or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.
You are entering into this End-User License Agreement ("EULA") between you and Blackjack Social only, and not with Apple Inc. ("Apple"). Blackjack Social, not Apple, is solely responsible for the App and its content.
This EULA may not provide for usage rules for the App that are less restrictive than the Usage Rules set forth in the Apple Media Services Terms and Conditions. You acknowledge that you have had the opportunity to review those rules.
Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. To the extent that any maintenance and support services are required by applicable law, Blackjack Social, not Apple, is obligated to provide them.
Apple has no warranty obligation whatsoever with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be solely governed by this EULA and any law applicable to us as the provider of the App.
Blackjack Social, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Blackjack Social, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
You must be at least 17 years old to use the App, consistent with the App's age rating on the Apple App Store. By using the App you represent that you are 17 or older. If we learn that a user is under 17 we will terminate their account.
You must have a valid Apple ID and a device capable of running iOS 16 or later to download and use the App.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial entertainment purposes. This license does not include the right to sublicense, sell, resell, distribute, or modify the App or its content.
All rights not expressly granted to you are reserved by Blackjack Social.
Blackjack Social is a free-to-play social entertainment game. All gameplay uses virtual chips ("chips") that have no monetary value whatsoever in the real world. Chips cannot be exchanged, redeemed, cashed out, or transferred for real money, goods, or services of any kind — within the App or anywhere else.
No real gambling or real wagering occurs within the App. Nothing in the App constitutes an offer to participate in real-money gambling.
Chips may be lost or forfeited due to normal gameplay outcomes, violations of these Terms, or account termination. We have no obligation to restore lost chips except at our sole discretion.
The App offers an optional Premium subscription at $4.99 per month, billed through Apple's In-App Purchase system ("Premium"). Premium grants the following benefits: higher maximum bet limits in-game, a monthly bonus chip grant, and removal of all advertisements.
You agree not to:
All content in the App, including but not limited to graphics, card designs, sound effects, animations, text, and software code, is owned by or licensed to Blackjack Social and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, or otherwise exploit any App content without our express written permission.
Your username and any in-game content you create (such as a custom display name) remain your property, but by creating them within the App you grant us a worldwide, royalty-free, non-exclusive license to use, display, and store that content as necessary to operate the App.
We may suspend or permanently terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our sole discretion. Upon termination:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLACKJACK SOCIAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10 USD, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Blackjack Social and its affiliates, officers, agents, employees, and partners from any claim, demand, loss, damage, or expense (including reasonable attorneys' fees) arising out of or related to: (i) your use of the App; (ii) your violation of these Terms; or (iii) your violation of any rights of another user or third party.
These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction where Blackjack Social operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction. We and you both consent to personal jurisdiction in those courts.
We reserve the right to modify these Terms at any time. We will update the "Last updated" date at the top and may notify you within the App when we make material changes. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please stop using the App and cancel any active subscriptions.
If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
